YUVAFACE TERMS AND CONDITION

YUVAFACE PRIVACY POLICY:
User shall also refer to Yuvaface's Application Privacy Policy available on YUVAFACE's website or Application which governs use of the Websites or Application. By using the Website or Application, User agrees to the terms of the Privacy Policy and accordingly consents to the use of the User’s personal information by Yuvaface Application, SOMANSH Infotech Private Limited and its affiliates in accordance with the terms of the Privacy Policy.

We believe you should always know what data we collect from you and how we use it, and that you should have meaningful control over both. We want to empower you to make the best decisions about the information that you share with us (SOMANSH Infotech Private Limited)

That’s the basic purpose of this Privacy Policy, terms and conditions to use Yuvaface Application for the use it was permitted by the user. You should read this policy in full to understand it for Global use without causing harm to the private rights of any other individual, but here are a few key things we hope you take away from it:

Yuvaface Application is public and things posted by user is immediately viewable and searchable by anyone around the world who were authorised and permitted to use it. We give you non-public ways to communicate on Yuvaface too, through protected post and Direct Messages. You can also use Yuvaface under a pseudonym if you prefer not to use your name.

When you use Yuvaface Application, even if you’re just looking at Newsfeed Post at individual level, Village level, Taluka level and district level we receive some personal information from you like the type of device you’re using and your IP address. In addition to information provided to use Yuvaface Application, you can choose to share additional information with us like your email address, phone number, address book contacts, and a public profile. We use this information for things like keeping your account secure and showing you more relevant Post, personalities, Business centres, social platform and people known and to follow, events in vicinity, and permitted ads by the some users.

On request we can further give you control through your personal settings to limit the data we collect from you and how we use it, and to control things like account security, marketing preferences, who can see you, apps that can access your account and things you’ve uploaded to. You can also always download the information you have shared on Yuvaface.

In addition to information you share with us, we use your Yuvaface, content you’ve read, Liked, or Reposted, and other information to determine what topics you’re interested in, your age, the languages you speak, and other signals to show you more relevant content and for your search. We give you transparency into that information, and you can modify or correct it at any time.

If you have questions about this policy, how we collect or process your personal data, or anything else related to our privacy practices, we want to hear from you. You can contact us at any time and can give your valuable suggestions.

CONTENT ON SERVICE:

It is important to take note that, as permitted by the Application all contents provided by the individual users having different kinds of accounts, and contents made available through various Sales Channels, including but not limited to audio, images, software, text, icons and such similar contents which will be available are registered with Yuvaface and protected under applicable intellectual property laws. User cannot use this Content for any other purpose or without prior permission for personal use, except as specified herein.

What contents you are permitted to upload;

1. When You as authorised user and when permitted to submit, upload, transmit or display any data, information, media or other content, including but not limited any photos, profiles (including Your name and image), messages, text, video, music, third party links), in connection with Your use of Services (" Your personal Content")， You understand and agree that:
   1. You will continue to own and be responsible for Your Content and its authenticity for all purposes
   2. We will not sell Your Content to any third party or no responsibility of its submitted authenticity as service provider;
   3. You are giving us and our affiliate companies the right to use Your Content which you shared/ posted (with no fees or charges payable by us to You) solely for the purposes of providing, promoting, developing and trying to improve Application and our other services, including new applications/ platform or services that we may provide in the future through Somansh Infotech Pvt Ltd. All such use will be in accordance with our Privacy Policy and without violation of applicable laws;
   4. In using Your Content which you posted for Public view and for these purposes, we and our affiliate companies may copy, reproduce, host, store, process, adapt, modify, translate, perform, distribute and publish Your content worldwide in all media and by all distribution methods, including those that are developed in the future;
   5. We may use the name that You submit in connection with Your Content (whether that be your account name, real name or otherwise); and
   6. We may share Your Content with third parties that we work with to help provide, promote, develop and improve Services, but these third parties (other than our affiliate companies) will not make any separate use of Your Content for their own purposes (i.e. for any purposes that are not related to Services);
   7. You will comply with these Terms in your submission of Your Content before start using the Application.
2. In addition, you agree that we and our affiliate company can use or reproduce (subject to these Terms, our Privacy Policy and applicable laws and regulations):
   
   1. You are allowed to retain and continue to use Your Content after you stop using Services – for example, where you have shared Your Content with other users of Services;
   2. you may be required to retain or disclose Your Content in order to:
   1. comply with applicable laws or regulations while sharing your post and expressing your views;
   2. comply with a court order, subpoena or other legal process; which applicable for the contents you post or circulate or
   3. respond to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere);
   and
   3. may need to retain or disclose Your Content in order to enforce these Terms, protect our rights, property or safety, or the rights, property or safety of our affiliate companies or other users of Services.
3. You understand that even if You seek to delete Your Content from Application, it may as a technical and administrative matter take some time or not be possible to achieve this – for example, we may not be able to prevent any third party from storing or using any of Your Content that you have made public via Application before deleting the same.
4. Our Company reserve the right to block or remove Your Content for any reason, including as is in our opinion appropriate or as required by applicable laws and regulations.
5. You are solely responsible for Your Content and we recommend that You keep a back-up copy of it at all times.
   1. You must at all times ensure you have the rights required to submit, transmit or display Your Content, and to grant us the rights as set out in these Terms; and
   2. Your Content (and our use of Your Content in accordance with these Terms) does not infringe or violate the rights of any person or otherwise contravene any applicable laws or regulations.

User agrees to follow all instructions provided by Yuvaface which will prescribe the way such User may use the Content.
There are a number of proprietary logos, service marks and trademarks displayed on the Website and through other Sales Channels of Yuvaface, as may be applicable. Yuvaface does not grant the User a license, right or authority to utilize such proprietary logos, service marks, or trademarks in any manner. Un authorized use of the Content, will be in violation of the applicable law.
Yuvaface respects the intellectual property rights of others. If you notice any act of infringement on the Website, you are requested to send us a written notice/ intimation which must include the following information;

• Clear identification of such copyrighted work that you claim has been infringed;
• Location of the material on the Website, including but not limited to the link of the infringing material;
• The proof that the alleged copyrighted work is own

What Kind of Information We Collect:
In providing Application, we collect, store and use the following Information relating to you:
Personal Information:
"Personal Information" is information that identifies you or another person. Personal Information may include the following:

1. information you make available to us when you open a Yuvaface account or use another service, such as your name, telephone number, email address;
2. any information included in your publicly visible Application profile, which may include your profile ID, name and photo;
3. information you make available to us and/or public via your use of Application and/or another service which you use to open your Yuvaface account;
4. Information made available by another user about you via their use of Application; and
5. Information we collect as you use Application, such as certain Location Data and Log Data.
1. " Location Data" is information that we collect regarding your location (when you use a location-enabled service), including:
   1. the location of your device when you use Application, such as from the GPS, Wi-Fi, compass, accelerometer or other sensors in your mobile device;
   2. the IP address of the device or internet service you use to access Application; and
   3. other information made available by you or others that gives an indication as to where you are or have been located, such as account information that indicates where you are located, and shared information that you or others post which indicates your location.
2. " Log Data" is technical information that is automatically collected by us when you use Application, whether through the use of cookies, web beacons, log files, scripts and e-tags or otherwise, including:
• technical information, such as your mobile carrier-related information, configuration information made available by your web browser or other programs you use to access Application, your IP address and your device's version and identification number;
• information about what you have searched for and looked at while using Application, such as web search terms used, social media profiles visited and details of other information and content accessed or requested by you in using Application;
• information about communications you have made using Application, such as the people you've communicated with and the time, data and duration of your communications; and
• metadata, which means information related to as you have made available through Application, such as the date, time or location that a shared photograph or video was taken or posted.
Non-Personal Information
Non-Personal Information is any information that relates to you but from which it is not practicable to directly or indirectly identify you, which may include the information about your devices (such as Your hardware model, operating system version, unique device identifiers, and mobile network information), the list of installed apps on your devices, and technical information about users means of connection to our apps, such as the versions of phone model and other similar information.
How We Use Collected Information
1. We may use your Information for any purpose as below:
   1. to provide Application and Services (and the features within Application) to you, such as to show to other users in Yuvaface such as your connected follower or other users on the platform;
   2. to provide you with advertising and direct marketing that is more relevant to you;
   3. to better understand how you access and use Application, in order for us to improve Application and respond to customer desires and preferences, including for us to provide language and location customisation, personalised help and instructions, or other responses to your and other customers' usage of Application;
   
   
   4. to help develop our service and provide, maintain, improve and modify the Applications, Services and the Site and develop new services;
   5. to assess the effectiveness of and improve advertising and other marketing and promotional activities on or in connection with Application
2. If any of your Personal Information comprises Your Content (as defined in the Terms of Service), we and our affiliate companies may (subject to this Privacy Policy) use such Personal Information in accordance with the "Your Content" section of the Terms of Service.
3. The data we collect depends on the context of your interactions with us, the choices you make, including your privacy settings, and the products and features you use. The data we collect can include SDK/API/JS code version, browser, Internet service provider, IP address, platform, timestamp, application identifier, application version, application distribution channel, independent deice identifier, iOS ad identifier (IDFA), Android ad master identifier, network card (MAC) address, and international mobile device identification code (IMEI) The equipment model, the terminal manufacturer, the terminal device operating system version, the session start / stop time, the location of the language, the time zone and the network state (WiFi and so on), the hard disk, the CPU, and the battery use, etc.
4. To improve our product and provide you better service, we also share personal data with vendors or agents working on our behalf for the purposes described in this privacy policy. For example, companies we've hired to provide data analytical services may need collect and access to personal data to provide those functions. In such cases, these companies must abide by our data privacy and security requirements.
5. We process Personal Data for the purposes set out in this Privacy Policy, as described above. Our legal basis to process personal data includes processing that is: necessary for the performance of the contract with you (for example, to provide you with the services you request and to identify and authenticate you so you may use the Sites); necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement); necessary for our legitimate interests (for example, to manage our relationship with you, to ensure the security of our services, to communicate with you about our products and services); and based on consent by our customers (for example, to place certain cookies and to share your information with third parties for advertising purposes). In some instances, you may be required to provide us with Personal Data for processing as described above, in order for us to be able to provide you all of our services, and for you to use all the features of our Sites.
6. Subject to limitations in applicable law, you are entitled to object to or request the restriction of processing of your Personal Data, and to request access to, rectification, erasure and portability of your own Personal Data. Where the use of your information is based on consent, you can withdraw this consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. Requests should be submitted by contacting us through yuvaface.com. If you are aware of changes or inaccuracies in your information, you should inform us of such changes so that our records may be updated or corrected. You may lodge a complaint with a supervisory authority if you consider that our processing of your Personal Data infringes applicable law. We retain your Personal Data as long as needed to provide services or products to you, or as required or permitted by applicable laws, such as tax and accounting law



ADVERTISMENT BOOKING BY YUVAFACE PARTNER:
Except with the prior registration with Yuvaface as B2B Yuvaface Partners, priority partner or a franchisee, and explicit permission of Yuvaface to use the Website or Application, all Yuvaface partners. If any such bookings are detected, Yuvaface reserves the right, including without limitation, to cancel all such Advertisement bookings immediately without any notice to such Yuvaface Partners and also to withhold payments or any refunds thereto. Yuvaface shall not be held liable for any incidental loss or damage that may arise from the Advertisement bookings made by any person through such Yuvaface partner. The liability in case of such cancellation.
All discounts and offers mentioned on the Website & Application are applicable only to User for legitimate Ads bookings.

ELIGIBILITY TO USE

The User must be at least 18 years of age and must possess the legal authority to enter into an agreement so as become a User and use the services of Yuvaface.
Before using the Website, approaching any Sales Channels or procuring the services of Yuvaface, the Users shall compulsorily read and understand this User Agreement, and shall be deemed to have accepted this User Agreement as a binding document that governs User's dealings and transactions with Yuvaface. If the User does not agree with any part of this Agreement, then the User must not available Yuvaface's services and must not access or approach the Sales Channels of Yuvaface.
All rights and liabilities of the User and Yuvaface with respect to any services or product facilitated by Yuvaface shall be restricted to the scope of this User Agreement.

USER'S RESPONSIBILITY

Users are advised to check the description of the services and products carefully before making Advertisement booking. User(s) agree to be bound by all the conditions as contained in Advertisement booking confirmation. These conditions are also to be read in consonance with the User Agreement.
If a User intends to make a Advertisement booking on behalf of another person, it shall be the responsibility of the User to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.
The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations of the concerned jurisdiction regarding use of the services for each transaction.

The services are provided on an "as is" and "as available" basis. Yuvaface may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. Yuvaface expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, reasonably fit for all purposes. No advice or information, whether oral or written, which the User obtains from Yuvaface or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.
User also authorizes Yuvaface's representative to contact such user over phone, message and email. This consent shall supersede any preferences set by such User through national customer preference register (NCPR) or any other similar preferences.

SECURITY AND ACCOUNT RELATED INFORMATION

While registering on the Website and Application, the User will have to choose a password to access that User's account and User shall be solely responsible for maintaining the confidentiality of both the password and the account as well as for all activities on the account. It is the duty of the User to notify Yuvaface immediately in writing of any unauthorized use of their password or account or any other breach of security. Yuvaface will not be liable for any loss that may be incurred by the User as a result of unauthorized use of the password or account, either with or without the User's knowledge. The User shall not use anyone else's account at any time.
User understands that any information that is provided to this Website and Application may be read or intercepted by others due to any breach of security at the User's end.
Yuvaface keeps all the data in relation to credit card, debit card, bank information etc. secured and in an encrypted form in compliance with the applicable laws and regulations. However, for cases of fraud detection, offering Advertisement bookings on credit (finance) etc., Yuvaface may at times verify certain information of its Users like their credit score, as and when required.
Yuvaface adopts the best industry standard to secure the information as provided by the User. However, Yuvaface cannot guarantee that there will never be any security breach of its systems which may have an impact on User's information too.
The data of the User as available with Yuvaface may be shared with concerned law enforcement agencies for any lawful or investigation purpose without the consent of the User.


FEES AND PAYMENT

In addition to the cost of Advertisement on booking as charged by the Service Providers, Yuvaface reserves the right to charge certain fees in the nature of convenience fees or service fees. Yuvaface further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.
In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, Yuvaface shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to Yuvaface. In cases where the short charge is claimed prior to the utilization of the booking, Yuvaface will be at liberty to cancel such bookings if the amount is not paid before the utilization date.
Any increase in the price charged by Yuvaface on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the User. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.
In the rare circumstance of a booking not getting confirmed for any reason whatsoever, Yuvaface will process the refund of the booking amount paid by the User and intimate the User about the same. Yuvaface is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and Yuvaface as the case may be.
The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws
The User agrees and understands that all payments shall only be made to bank accounts of SIPL. Yuvaface or its Yuvaface Partners, agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of Yuvaface. The User agrees that if that user transfers any amount against any Advertisement booking or transaction to any bank account that is not legitimately held by SIPL or to any personal account of any person, SIPL shall not be held liable for the same. User shall not hold any right to recover from SIPL any amount which is transferred by the User to any third party.
The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, Yuvaface Partners, employees or representatives of SIPL . The User shall immediately inform SIPL if such details are demanded by any of its agents' employees or representatives. SIPL shall not be liable for any loss that the User incurs for sharing the aforesaid details.
Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking.
Booking(s) made by the User through SIPL are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing. USAGE OF THE MOBILE NUMBER, COMMUNICATION DETAILS OF THE USER BY SIPL. Yuvaface will send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the User, via SMS, internet-based messaging applications like , voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.

RIGHT TO REFUSE

Yuvaface at its sole discretion reserves the right to not accept any booking Ads without assigning any reason thereof.
Yuvaface will not provide any service or share confirmed booking details till such time the complete consideration is received from the User.
In addition to other remedies and recourse available to Yuvaface under this User Agreement or under applicable law, Yuvaface may limit the User's activity, warn other users of the User's actions, immediately suspend or terminate the User's registration, or refuse to provide the User with access to the Website or Application if:
• The User is in breach of this User Agreement; or
• Yuvaface is unable to verify or authenticate any information provided by the User; or
•Yuvaface believes that the User's actions may infringe on any third-party rights or breach any applicable law or otherwise result in any liability for the User, other users of Yuvaface, or Yuvaface itself.
Once a User has been suspended or terminated, such User shall not register or attempt to register with Yuvaface with different credentials, or use the Website or Application in any manner whatsoever until such User is reinstated by Yuvaface. Yuvaface may at any time in its sole discretion reinstate suspended users.
If a User breaches this User Agreement, Yuvaface reserves the right to recover any amounts due to be paid by the User to Yuvaface, and to take appropriate legal action as it deems necessary.
The User shall not write or send any content to Yuvaface which is, or communicate with Yuvaface using language or content which is:

• abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar, sexually explicit, pornographic, illicit or otherwise objectionable;
• contrary to any applicable law;
• violates third parties' intellectual property rights;
• in breach of any other part of these terms and conditions of use.
• If the User violates any of the aforesaid terms, Yuvaface shall be at liberty to take appropriate legal action against the User.

RIGHT TO CANCEL

The User expressly undertakes to provide Yuvaface with correct and valid information while making use of the application or Website under this User Agreement, and not to make any misrepresentation of facts. Any default on part of the User would disentitle the User from availing the services from Yuvaface.
In case Yuvaface discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of the Advertiser is not correct or that any fact has been misrepresented by that User, Yuvaface, SIPL shall be entitled to appropriate legal remedies against the User, including cancellation of the bookings, without any prior intimation to the User. In such an event, Yuvaface shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.
If any judicial, quasi-judicial, investigation agency, government authority approaches Yuvaface to cancel any Ads booking, Yuvaface will cancel the same without approaching the concerned User whose Ads booking has been cancelled. The User shall not hold Yuvaface responsible for any loss or damage arising out of measures taken by Yuvaface for safeguarding its own interest and that of its genuine customers. This would also include Yuvaface denying or cancelling any bookings on account of suspected fraud transactions.
CALLS AND OTHER SIMILAR PHISHING, SPAMMING OR FRAUDULENT ACTIVITIES SIPL's employees or authorized representatives will never contact a User asking for his/ her credit or debit card number, expiry date, CVV, net banking login, passwords, OTP etc. nor will they ever request for a fund transfer to a personal or an individual bank account. Further, they will also not ask a User to install any third-party applications that enable them to view a User's mobile or computer screen.
Acting on any of these requests may make you a victim of fraud, and may potentially lead to loss of your valuable money or information.

Disclaimer and Limitation of Liability

1. We only provide You an application which can play and upload healthy and legitimate contents. Please do not use the Application to hurt anyone or engage in illegal activities. If Your behavior causes any damages or infringes any third party's legitimate rights, You may solve Yourself and bear corresponding liabilities of compensation.
2. We will not assume any guarantee or warranty liabilities for any third-party software, services, or applications.
3. Except as expressly set forth in this TOS, neither Yuvaface, its affiliates, subsidiaries nor the Licensors make any other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose. Yuvaface, its affiliates, subsidiaries and the Licensors expressly disclaim all warranties not stated in this TOS. Any implied warranties that may be imposed by law are limited to the terms contained in this TOS to the maximum extent permitted by law.
4. To the maximum extent permitted by applicable laws, under no circumstance shall Yuvaface, its affiliates, subsidiaries and the Licensors be liable to You or any third person for personal injury, or any special, incidental, indirect, punitive or consequential damages whatsoever, including, but not limited to, damages for loss of profits or revenues, goodwill, failure to transmit or receive any data, loss of confidential information, business interruption, loss of privacy, corruption or loss of data, failure to receive or backup Your data (or archived data), for any cause of action, including contract, tort (including negligence) or otherwise and any other loss whatsoever arising out of or in any way arising from or related to the use of Application, or following a failure, suspension or withdrawal of all or part of the Application at any time, any third party content, software or functions used in connection with the Application even if Yuvaface, its affiliates, subsidiaries and the Licensors have been advised of the possibility of such damages.
5. You agree to indemnify, defend and hold harmless Yuvaface, its subsidiaries, affiliates and Licensors and each of their respective officers, directors, employees, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost, demand or expense (including but not limited to attorney's fees) of any kind arising out of:
   1. Your access to or use of the Application and related services;
   2. any breach by You of Your obligations under this Agreement;
   3. Your violation of the rights of a third party, including but not limited to infringement of any intellectual property, proprietary right or trade secret of any person or entity, or of any privacy or consumer protection right that is implicated herein;
   4. any violation of law or contractual obligation and any claims, demands, notices pursuant to such violation;
   5. Your negligence or will full misconduct. These obligations will survive termination of this Agreement.
6. If your behavior does not comply with the Terms of Service or related laws and regulations and is found out by means of notification or report, we have the right to make independent judgment. We also have the right to terminate some or all of the services provided to you immediately without informing you. If your behavior causes any third party to lodge claims or causes damage or loss, you may assume full responsibility



INDEMNIFICATION

The User agrees to indemnify, defend and hold harmless Yuvaface, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant by the User.
The User shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and SIPL cannot be held responsible for the same.

MISCLLEANEOUS SEVERABILITY:

If any provision of this User Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this User Agreement shall continue to be in full force and effect.


JURISDICTION:

This Agreement is subject to interpretation as per the laws of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in North Goa, Goa.

AMENDMENT TO THE USER AGREEMENT:

Yuvaface, SIPL reserves the right to change the User Agreement from time to time. The User is responsible for regularly reviewing the User Agreement.

CONFIDENTIALITY:

Any information which is specifically mentioned by SIPL as confidential shall be maintained confidentially by the User and shall not be disclosed unless as required by law or to serve the purpose of this User Agreement and the obligations of both the parties herein.
Yuvaface, SIPL would like to know the feedback of the Users for improving its services.

Termination

1. This Agreement commences on the date You accept the Terms of this Agreement. We may terminate or suspend use of the Application at any time in our discretion, without notice to You. Upon any termination for any reason, we shall have no liability to You and no further obligations under this Agreement.
2. Immediately upon termination: (a) the rights granted to You herein shall terminate; (b) You must cease all use of the Application and related services.
3. Your rights under this Agreement will terminate automatically if You fail to comply with any term(s) of this Agreement including misuse of the Application.
4. All sections that may be reasonably interpreted to or are intended to survive this Agreement will survive this Agreement. Governing Law and Disputes
   
   1. This Agreement shall in all respects be governed by and construed and enforced in accordance with the laws of India. You irrevocably consent to the exclusive jurisdiction of competent courts in North Goa, Goa, India for all disputes arising out of or relating to this Agreement.
   2. For any dispute you have with us, you agree to first contact us and attempt to resolve the dispute with us informally.

General Terms and Conditions

1. Entire Agreement.
   You acknowledge that You have read this Agreement, understand it and agree to be bound by its terms and conditions. You also agree that this Agreement read with the terms of the Privacy Policy is the complete and exclusive statement of the Agreement between Yuvaface and You and supersedes all proposals, representations or prior agreements, oral or written, and any other communications between Yuvaface and You relating to the subject matter of this Agreement.
2. Severability
   The invalidity or unenforceability of any provision of this TOS will not affect the validity or enforceability of any other provision, the remaining provisions being deemed to continue in full force and effect.
3. Assignment
   We may assign this TOS or any of the rights or obligations hereunder, and any causes of action arising hereunder, to any third party without necessity or obligation of notice to you.
4. Amendments to this Agreement
   We may in our sole discretion amend this Agreement from time to time without any prior notice. This may include adding new or different terms to, or removing terms from, this Agreement. Such change shall be notified in the Application. Your use of the Application after such notice of any change shall be deemed to be an acceptance to the amended Agreement.
5. Force Majore
   We will not be responsible for any failure to perform its obligations under this TOS due to circumstances beyond its reasonable control, including without limitation acts of God, war, riot, terrorism, embargoes, acts of civil or military authorities, fire, flood or accidents and pandemic situation. You agree that Yuvaface will be entitled to all legal and equitable remedies otherwise available to it to protect the intellectual property, proprietary rights and Confidential Information of itself and its Licensors, including without limitation, the right to seek and obtain injunctive relief and enforce the same against you without the necessity of having to post bond or other such guarantee.
